These Terms of Service (“Terms”) govern your access to and use of the website blossomhealthservices.site and the health and wellbeing services provided by Blossom Health Services Pty Ltd (ABN 90 702 554 096) (“we”, “us”, “our”). By engaging our services, submitting an enquiry or requesting a quote through this website, you agree to be bound by these Terms.

Blossom Health Services Pty Ltd is a health and wellbeing services provider based in Perth, Western Australia. We deliver supports and services designed to promote independence, wellbeing and quality of life for our clients across the Perth metropolitan area.

2. Nature of Our Services

Our services support general health and wellbeing. They are not a substitute for medical diagnosis, treatment or clinical care provided by a registered health practitioner. Nothing on this website constitutes medical advice. If you have a medical concern, please consult your general practitioner or other appropriate registered health professional. In an emergency, contact emergency services immediately.

3. Quotes, Bookings and Engagement

  • Any quote provided by us is an estimate based on the information available at the time and is valid for 14 days unless otherwise stated in writing.
  • A binding service agreement is formed only when we confirm your booking or engagement in writing (including by email).
  • The specific scope, schedule and fees for your services will be set out in your service agreement or written confirmation.
  • We may decline or discontinue an engagement where, in our reasonable opinion, we are unable to safely or appropriately deliver the requested services.

4. Fees and Payment

  • Fees for our services will be communicated to you in writing before services commence and will not be increased during an agreed service period without prior written notice.
  • Invoices are payable within the period stated on the invoice, which is normally 14 days from the date of issue.
  • If an invoice remains unpaid, we may suspend services until the outstanding amount is settled.
  • All fees are quoted in Australian dollars and include GST where applicable.

5. Cancellations and Rescheduling

We ask that you provide as much notice as possible if you need to cancel or reschedule a scheduled service. Where a service agreement specifies a cancellation notice period, cancellation fees may apply for late notice or non-attendance. We will always explain any applicable cancellation terms before you engage our services.

If we need to cancel or reschedule a service, we will provide you with as much notice as practicable and work with you to arrange a suitable alternative.

6. Your Responsibilities

When engaging our services, you agree to:

  • provide accurate, current and complete information relevant to the delivery of services;
  • treat our staff and contractors with courtesy and respect;
  • provide a safe and suitable environment for the delivery of in-home or on-site services;
  • give reasonable notice of any change in your circumstances that may affect service delivery; and
  • comply with any reasonable policies or procedures we communicate to you.

7. Privacy

We respect your privacy and handle personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy. By engaging our services, you consent to the collection, use and disclosure of your personal information as described in that policy.

10. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot lawfully be excluded, restricted or modified.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund of the price paid, or a replacement of the service. For minor failures, we may, where permitted, choose to provide a resupply of the services or payment of the reasonable cost of resupplying them.

11. Limitation of Liability

To the maximum extent permitted by law, and subject to clause 10, we exclude all liability for any loss, damage, cost or expense arising from your use of this website or our services, including indirect or consequential loss. Where liability cannot lawfully be excluded, our liability is limited, at our option where permitted, to the resupply of the relevant services or the payment of the reasonable cost of resupplying those services.

12. Termination

Either party may end a service agreement in accordance with the notice period set out in that agreement. We may suspend or terminate services immediately if you breach these Terms or a service agreement in a serious way, or if continuing the engagement would present an unacceptable risk to the safety or wellbeing of our staff, contractors or other clients.

13. Force Majeure

We will not be liable for any delay or failure to perform our obligations where that delay or failure is caused by an event beyond our reasonable control, including natural disasters, pandemics, industrial action, utility failures or other emergencies.

14. Changes to These Terms

We may update these Terms from time to time. The current version will always be published on this page, together with the date of the latest revision. Continued use of our website or services after an update constitutes acceptance of the revised Terms. Material changes affecting an active service agreement will be communicated to you directly.

15. Governing Law

These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. The parties submit to the jurisdiction of the courts of Western Australia.
